Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using Kitbench (kitbench.net, the “Service”), operated by AI Content Hub LLC (“we” or “us”). By using the Service, you (the “User”) agree to these Terms.

1. Scope

  1. These Terms apply to all use of the Service, including the web tools, the browser extensions and the paid plan “Kitbench Premium” (“Premium”).
  2. Information published on the Service, including the Legal notice, the Privacy Policy and each tool’s description, forms part of these Terms. Where it differs from these Terms, the specific information (such as a tool’s description) takes precedence.

2. The Service

  1. The web tools are free to use and need no account.
  2. Premium is a paid plan that unlocks features in the extensions and in some web tools. It costs ¥980 per month or ¥9,800 per year. Outside Japan, the checkout page shows the price in your local currency.
  3. We may add, change or discontinue parts of the Service. If we change Premium to your disadvantage or discontinue Premium, we will tell you in advance on the Service or by email.

3. Premium: purchase, payment and cancellation

  1. Payment and the sale of Premium are handled by Link, a service of Stripe. Payment methods and timing are as shown on the checkout page and in the Legal notice.
  2. Premium renews automatically every month (monthly plan) or every year (yearly plan).
  3. You can cancel at any time. After you cancel, you will not be charged from the next renewal date. You can cancel on the Link website (link.com) or by emailing us.
  4. Because Premium is a digital product, we do not offer returns or prorated refunds after payment. Refunds may be made under Link’s own terms.
  5. After payment, Premium is activated per browser. You can activate it in another browser with the email address used at purchase and the invoice number.

4. Sharing in the Website Annotation Tool

  1. When you create a share link in the Website Annotation Tool, the page content, marks, comments and replies are stored on our server, and anyone with the link can view and edit them.
  2. Stored reviews are deleted 7 days after a free link is created, or after 1 year for a Premium link. Deleted reviews cannot be restored.
  3. Do not share content that infringes others’ rights or contains personal information others would not want disclosed. Give share links only to the people working on the page.

5. Prohibited conduct

When using the Service, you must not:

  1. break the law or act against public order and morals;
  2. infringe anyone’s copyright, trademark, privacy or other rights;
  3. place excessive load on our servers, use the Service in bulk through automated means, or get around usage limits;
  4. use the Service to access or attack other people’s websites or servers without authorization;
  5. transfer, sell or share the key that activates Premium;
  6. otherwise interfere with the operation of the Service.

6. Data you enter

  1. Text and files you enter into the web tools are processed only in your browser and are not sent to us, except in the Website Annotation Tool as described in section 4.
  2. Personal information and analytics are handled as described in the Privacy Policy.

7. Rights

  1. Rights in the Service’s pages, tools, text and logos belong to us or to their rightful owners.
  2. We claim no rights in what you create with the Service (such as QR codes, merged PDFs or converted images).

8. Availability and results

  1. We work to keep the Service running correctly, but depending on your connection, device, browser or the condition of third-party websites you load, it may be temporarily unavailable or not work as expected.
  2. If you use a calculation or conversion result for an important decision involving money, health or a contract, please check it yourself as well.
  3. If you find a bug, please let us know through the contact page. We will work to fix it.

9. Liability

  1. If you suffer damage caused by our intentional misconduct or gross negligence, we will compensate you in accordance with the law.
  2. If you suffer damage caused by our negligence (other than gross negligence), our liability is limited to direct and ordinary damage you actually suffered, up to the total Premium fees you paid us in the 12 months up to and including the month the damage occurred (or ¥10,000 if you have paid no fees).
  3. The limit in the previous paragraph applies only to negligence other than gross negligence on our part.

10. Changes to these Terms

  1. We may change these Terms when necessary. We will publish the changed Terms and their effective date on the Service in advance.
  2. If a change is to your disadvantage, we will publish it well before the effective date and also notify Premium users by email.

11. Governing law and jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. Any dispute between you and us concerning the Service shall be submitted, in the first instance, to the district court having jurisdiction over our head office.
